The Compliance Process Simplified
Below is a summary of the property owner and pool safety inspector requirements and obligations based on the Building Regulations (2018). For more detailed information see Part 9A—Safety requirements for, registration of, and certification of barriers for, swimming pools and spas.
Step 1. Owner registers Pool or Spa with Local Council
As the owner you must register your pool and spa with your local council. This only needs to be done once. If this has already been done you can skip this step.
Step 2. Owner Obtains Registration Confirmation Letter
This letter will identify which version of the Australian Standards applies to your pool barrier. You'll need to make sure you have a copy of this letter before the inspection can be undertaken. If you already have this letter you can skip this step. Otherwise, contact your Council to determine which Australian Standard is applicable.
Step 3. Pool Safety Inspector Conducts Inspection
The Pool Safety inspector conducts a safety barrier inspection. Most the time the inspector will find non-compliances with the Safety Barrier which will be provided in a detailed report and onsite discussion outlining what needs to be repaired. If the inspection reveals that the barrier is compliant, skip to step 6.
Step 4. Owner Completes Repair Works (if required)
Once your inspector has provided you with a report detailing the non-compliant items, you will have 60 days to repair the safety barrier.

Step 5. Pool Safety Inspector Reinspects Safety Barrier (if required)
The Pool Safety Inspector reinspects the pool or spa safety barrier once the repair works have been completed. Further inspections may be required if repair works are not completed properly.
Step 6. Pool Safety Inspector Issues Certificate of Barrier Compliance (Form 23)
Once the pool or spa safety barrier is deemed to be compliant the property owner is provided with a Certificate of Barrier Compliance (Form 23).
Step 7. Owner provides Certificate (Form 23) to Council within 30 days
The owner must provide their Local Council with a copy of the Certificate of Barrier Compliance (Form 23) within 30 days of the certificate being issued.

As of 1 December 2019 Victoria implemented new Building Regulations requiring registration, inspection, and certification of swimming pools and spa.

You will be given an inspection report detailing a list of non-compliant items to be rectified. The Building Regulations stipulate that you must complete the repair works and have it reinspected with 60 days.
You are required to have your safety barrier inspected and lodge a Certificate of Barrier Compliance with Council every 4 years.
Inspection times will vary depending on the complexity and Australian Standard for your safety barrier. Typically this can vary from 15 to 60 minutes.
It is preferred that someone is available at the property. However, we can conduct an inspection so long as there is access available and written consent.
The Inspector must be a registered building practitioner with the Victorian Building Authority with one or more of the following registrations:
- Building Surveyor
- Building Inspector
- Building Inspector (Pool Safety)
